Partner Gregory S. Lisi Named a 2012, “Who’s Who in Labor Law,” by Long Island Business News

Uniondale, February 24, 2012 — Partner Gregory S. Lisi was listed  in Long Island Business News’ “Who’s Who in Labor Law 2012.” In the feature, Mr. Lisi was asked in this election year, what is one issue you are keeping your eye on in 2012?

He responded by stating, “From a Labor and Employment law standpoint, the most interesting question going into the presidential election is how the current health care system, i.e. Patient Protection and Affordable Care Act as amended by the Health Care and Education Reconciliation Act of 2010 (“Universal Health Care”), or any new healthcare system instituted by a Republican administration will effect employee benefits, employers’ actions and the company bottom line after the election.  For example, as the law currently reads beginning on January 1, 2014, firms employing 50 or more people, but not offering health insurance, will pay a $2,000 per employee tax penalty.  How this will be implemented, or if it will even survive, will be of great interest for business and employees alike.  By comparison, under the Massachusetts Health Care Insurance Reform Law (Mass Care), employers with more than ten full-time equivalent employees who do not provide a “fair and reasonable contribution” to the premium of health insurance for employees will be assessed an annual contribution that will not exceed $295 per employee per year. Mass. Act Chp. 58, sec. 47 (2006).  Should President Obama be reelected the statutes will likely remain intact and the questions going forward will be ones of implementation and enforcement.  Should a Republican Administration take over it will be very interesting to see if a version of the somewhat more moderate Mass Care will be instituted, or will the mandates of Universal Health Care be repealed altogether?”
