Ms. Simoncic successfully challenged the Village of Centre Island Zoning Board of Appeals denial of a variance to build a house on a vacant 3 acre waterfront piece of property. The Board granted three variances to allow the construction but denied a fourth that was also necessary to build. Without this fourth variance, the owner was unable to build anything and the property would be rendered virtually valueless. The Nassau County Supreme Court overturned the Board’s denial and directed it to grant the variance to develop a very valuable piece of property.
