LI Business News Includes Partner Elbert Nasis in Who’s Who in Labor Law

February 27, 2017 — Elbert F. Nasis, a partner in the Litigation and Employment & Labor Department of Forchelli, Curto, Deegan, Schwartz, Mineo & Terrana, LLP has been included in Who’s Who in Labor Law by LI Business News. The annual Who’s Who section features leading lawyers in various disciplines from Nassau & Suffolk Counties.

Elbert F. Nasis is a senior litigator handling complex matters and those involving high exposure in state and federal courts. His practice primarily focuses on litigation, from inception through trial, including the representation of corporations, small businesses, and individuals. He also has significant experience in complex insurance coverage litigation and real estate.

“A key issue in the employment and labor law areas in 2017 will likely be whether minimum wage laws and regulations will be affected by the new administration,” said Mr. Nasis. “President Trump’s new administration presents reinvigoration to the American Dream that many argue had been lost over the years with the closures of businesses and manufacturing plants across the United States. Hopefully, the new administration serves as a catalyst for the robust creation of jobs throughout the country. Although there is divergence between federal and state minimum wage requirements, employers must ensure compliance with that law which provides for the greater wage in their state.”

He noted that the current federal minimum wage of $7.25 per hour is less than that of approximately 30 states. He said that New York’s current hourly minimum wage for non-exempt employees ranges from $9.70 to $11.00 per hour, depending on geographic location, and in New York City, the total number of employees. “Not only must employers ensure that all employees are paid the requisite minimum wage and are properly paid for all regular hours, overtime hours, and spread of hours, if applicable, they must also maintain accurate records regarding their employees’ wages and deductions,” Mr. Nasis said.

Mr. Nasis is a member of the New York State Trial Lawyers Association and the New York State Bar Association. He is a graduate of the State University of New York at Stony Brook and the Touro College Jacob D. Fuchsberg Law Center.
