Anthony V. Curto and Donald Jay Schwartz worked together in a litigation matter on behalf of our client, T.V. and radio personality Michael Francesa, in successfully obtaining the return of his down payment for the purchase of a home.  This office brought suit against the Seller claiming that the Contract of Sale was breached by making the title unmarketable because the subject premises was burdened by unrelated property taxes and demanded the return of Mr. Francesa's down payment.  This office then made a motion for summary judgment claiming that our position was correct as a matter of law with no need for a trial. Judge Daniel Martin of the Nassau County Supreme Court agreed and granted this firm's motion and ordered the return to Mr. Francesa of his down payment.
